
The murder trial of Kasipul MP Charles Were took a disturbing turn after a suspect allegedly issued a death threat against the prosecutor during a court session held on Wednesday, June 4, 2025.

Threat Made in Open Court
Testifying in court, Police Constable Damian Mlongo stated that one of the suspects became irate after the prosecution opposed his release on bond. Mlongo quoted the suspect saying, “Huyu ni nani hataki tuachiliwe? Huyo tutamuua!”—loosely translated as, “Who is this who doesn’t want us released? We’ll kill them.”
When prompted by the judge, Mlongo pointed to the suspect wearing a white shirt in the dock.
Court’s Immediate Response
Presiding Judge Diana Kavedza ruled against granting bail to the suspect, citing the seriousness of the threat. She also ordered a psychiatric evaluation at Mathari Hospital.
“The mere utterance of the words ‘huyu tutamuua’ raises serious concerns. If a prosecutor can be threatened in open court, what about the witnesses?” she said.
Background of the Case
MP Charles Were was murdered in April shortly after leaving Parliament. Investigations indicate that individuals close to him may have collaborated with others in the killing, a revelation that triggered outrage among ODM party leaders.
The suspects remain in custody as the case continues. The next court hearing is scheduled for later this month.
