Why the High Court Threw Out Gloria Orwoba’s Bid to Stop UDA Expulsion

The High Court has dismissed an application filed by nominated Senator Gloria Orwoba, effectively clearing the way for her removal from the United Democratic Alliance (UDA) Party.

Judge Declares Application Incompetent

Delivering the ruling on Tuesday, High Court Judge Lawrence Mugambi said the application was flawed and violated court procedure. According to the judge, Orwoba introduced new parties into the petition without the court’s approval.

“The application is incompetent and is rejected. Previous directions are maintained,” ruled Justice Mugambi.

Orwoba Expelled from UDA Over Misconduct

On May 19, UDA announced that it had expelled Senator Gloria Orwoba, citing gross misconduct and disloyalty to the party. The decision came after a report by the party’s Disciplinary Committee, which recommended her immediate removal from the membership list.

“Having exhaustively deliberated on the matter, the Committee resolved that Senator Gloria Orwoba be expelled from the UDA Party with immediate effect,” read a statement by Secretary General Hassan Omar.

Privileges Revoked, Successor Named

Following her expulsion, UDA confirmed that Orwoba will no longer enjoy any rights or privileges associated with party membership. She is also barred from representing UDA in any official capacity.

The party has since written to the Speaker of the Senate requesting her removal. Notifications have also been sent to the Registrar of Political Parties (RPP) and the Independent Electoral and Boundaries Commission (IEBC).

To fill the vacant seat, UDA has nominated Consolata Wabwire Wakwabubi from Kimilili Constituency, Bungoma County. She was next on the party list submitted before the 2022 General Elections.

What’s Next for Orwoba?

With the High Court’s dismissal, Orwoba’s legal options appear limited unless she files a fresh petition that complies with procedural guidelines. Meanwhile, the Senate is expected to begin formal proceedings to replace her in the coming days.
